General conditions
Pay01 is an application for making payments and receiving payments (POS) owned by Italy01 Corporation. To use Pay01 you must be of age 18. Minors can only use Pay01 by involving a parent or guardian.

Usage costs
The use of app01 is free
If a user with a shop decides to subscribe to the app01 payment system to accept payments with credit cards or debit cards, both for products purchased in the app and for products purchased outside the app (app01 used as POS), the the following costs will be charged:

Exchange rate
If a current account with a currency other than the Euro is associated with the shop, the cost for the exchange is equal to 1% of the transaction plus the exchange rate for US accounts, 2% of the transaction plus the exchange rate for non US accounts.
Conflict of conditions
Pay01 offers additional services therefore a user could be subject to additional terms and conditions. In the event of a conflict between these general conditions and those of a specific Service, the latter will prevail.
Communications
Without prejudice to the specific provisions of the law, for the purposes of this contract, the user of Pay01 agrees to receive communications in electronic form and also accepts that all contracts, notifications, information and other communications in electronic form satisfy the requirement of the written form, when this is required by law.
Copyright and databases
All contents present or made available through Pay01 such as texts, images, logos, icon buttons, excel files, csv, are exclusively owned by Pay01 or its content suppliers and are protected by Italian law and international laws on copyright and database rights. It is not allowed to create or publish databases that reproduce substantial parts (e.g. prices and product lists) of Pay01 without the express written consent of Pay01.
Trademarks
All logos, headers, icons, fonts on Pay01 and pay01.com and on the materials and files of Pay01 are trademarks and distinctive signs of Pay01. The trademarks and distinctive signs of Pay01 cannot be used in relation to products or services other than Pay01 in such a way as to generate confusion among customers or in any way that could damage Pay01. All trademarks on Pay01 not owned by Pay01 are the property of their respective owners and may be used by Pay01 for the purpose of displaying and advertising the products.
License
Provided that the user complies with these General Conditions and the Terms of Service and pays any applicable fees, Pay01 and its content providers grant the user a limited, non-exclusive, non-transferable and non-sublicensable license for access the services of Pay01 and make a personal and non-commercial use. This license does not include any right of resale or commercial use of Pay01’s services or its contents. It does not include the right to collect and use product lists, descriptions or prices. This license does not entitle you to make any type of download or copy of account information for the benefit of another reseller or use data capture and extraction devices. All rights not expressly conferred by these conditions of use and by the terms of the service remain with Pay01 and its licensors and suppliers. It is not permitted to reproduce and use the services of Pay01 in whole or in part for any commercial use without the express written consent of Pay01. It is not allowed to appropriate any brand, logo, images, text of Pay01 without the express written consent of Pay01. The Pay01 services can only be used within the limits established by law. The violation of these conditions will result in the revocation of the authorization or license of use issued by Pay01.
Account
Anyone who uses the Pay01 services is required to keep his account and password confidential and to control access to his devices. The user accepts, within the limits permitted by applicable legal provisions, to be held responsible for all activities that will be carried out through his account and password. The user undertakes to take all necessary precautions to ensure that his password remains confidential and undertakes to notify Pay01 immediately if any third party has used his data in an unauthorized manner (e-mail for communications support @ pay01.com). The user is required to make sure that the data provided to Pay01 are correct and to update them immediately with each change if there is any. The user can access and update his information in the “My Account” section of the Pay01 application.The user agrees not to use the services of Pay01 in a way that could cause or could cause service interruptions or damage. The user agrees not to use Pay01’s services for fraudulent purposes, or in any case to commit illegal activities. Pay01 reserves the right to prevent access and to suspend or close an account, to remove or modify the contents of the profile or shop or any other Pay01 service in case of violation of the provisions of these General Conditions.
Communications
If a user believes that a content on Pay01 contains a defamatory statement or that an intellectual property right has been violated by an article or information on Pay01, we invite the user to report this fact to us by electronic post-auction by clicking on [email protected]
Activities of sellers
Subjects other than Pay01 manage shops, provide services, or sell products and processes on the Pay01 application. Pay01 is not responsible for the control or evaluation of these subjects. Pay01 does not offer guarantees on the sales and proposals of these subjects and does not protect the buyer by withholding payment until the correct delivery of the goods or service purchased. Pay01 therefore invites you to buy from nearby sellers whose existence is easily verifiable by the buyer. Pay01 cannot in any way be held responsible for the actions, products and contents of sellers on the Pay01 application or for those of any third party. The return criteria and product warranties are policies that belong to the physical and legal entities that sell through Pay01. By purchasing the products and services on the Pay01 application, the buyer fully accepts these criteria.
Responsibility of Pay01
Pay01 will do everything possible to ensure that access to the application and its services is provided without interruptions and that transmissions take place without errors. However, due to the nature of the Internet, this access cannot be fully guaranteed. The various accounts and accesses to the application may be occasionally suspended or limited to allow the carrying out of repairs, maintenance, or the introduction of new services. Pay01 will endeavor to limit the frequency and duration of these suspensions and limitations. Pay01 in any case will not be responsible for loss of commercial opportunities due to the performance of these activities.
Applicable law and competent court
These conditions are regulated and must be interpreted in accordance with Italian law. For any dispute the competent court will be that of Vicenza.
Changes
Pay01 reserves the right to modify any service, pricing policies, these conditions and the terms of use of the service at any time to offer new products or services or to adapt the application to new legal or market provisions. The user is subject to the policies and terms of the conditions of use from time to time in force at the time the Pay01 application is used. Should any of these conditions be deemed invalid, null or unenforceable, this condition will in any case not affect the validity and effectiveness of the other conditions.
Patents
The logics, services, layouts, functions of Pay01 are protected by patents owned by Pay01.
POS
Any user will be able to activate the POS service from the Pay01 application settings. To activate the POS it is necessary to follow the guided procedure and be equipped with documents and an IBAN on which to receive payments. Through the POS the user will be able to receive payments from credit/debit cards, E-wallets, installment payments with Klarna and other systems that can be activated from your Stripe profile. The cards accepted are those of the major national and international circuits. The accepted e-wallets are those of the most famous international circuits such as Apple Pay, Google Pay. Other wallets such as AliPay and We Chat Pay can be activated from each user’s Stripe profile. Through the POS it will be possible to receive contactless payments by scanning the QR Code. The paying user, by scanning the QR code of the receiving user, connects to the latter’s account and by selecting a payment method can transfer the amount due by entering the data required. The POS service is subject to the costs displayed at the beginning of the Terms of Use. The costs concern only the POS owner. The user who pays is not subject to any costs. The user with the POS will be able to change his data at any time, delete his POS or delete his account. Pay01 partners with Stripe to ensure secure payments and financial services.
Commercial Policy
The Seller offers the products for sale on the Pay01 application and carries out its commercial activity exclusively towards end users. End users are any person using the Pay01 application. These General Conditions of Sale exclusively regulate the offer, forwarding and acceptance of purchase orders for products on the Pay01 application between Pay01 users and the seller. The General Conditions of Sale, on the other hand, do not regulate the supply of services or the sale of products by parties other than the Seller which may be present on Pay01 through links, banners or other links. These General Conditions of Sale do not regulate the supply of services or the sale of products or processes outside Pay01 even if the seller with whom there is the commercial relationship has been contacted through the Pay01 application.
Conclusion of the contract
To conclude the purchase contract for one or more products or services on Pay01, the buyer must register and fill out the order form in electronic format that will be sent to the seller. Before proceeding with the purchase of products through the order form, the buyer must carefully read the General Conditions of Sale and accept them. The order form will be stored on Pay01’s servers for the period necessary to process the order in compliance with the terms of the law. The buyer can access his order form by entering the application and clicking “My Orders”. At the time of sending the order form, the buyer will be asked to indicate the payment method (payment on delivery or payment by credit card). Once the contract is concluded, the seller will process the purchase order. The seller will have the right not to process purchase orders that do not give sufficient guarantees of solvency or that are incomplete or incorrect or in the event of unavailability of products (if they have been sold at the same time as the order is received) . In this case the seller must promptly cancel the order. In the event that the order has not been processed and the payment of the price has been made by credit card, the seller must contact the buyer and reimburse, without undue delay, the amount already advanced by the buyer and the contract will be understood as resolved between the parties. With the electronic transmission of the order form, the buyer and the seller unconditionally accept and undertake to observe these General Conditions of Sale. Once the contract is concluded, the seller must issue a receipt or invoice in the format required by law. Pay01 declines as of now any responsibility regarding the non-fulfillment of tax obligations of subjects other than Pay01.
Withdrawal and return
Each seller on Pay01 applies its policy of withdrawal and return compatibly with Italian law. Pursuant to art. 57, paragraph II, of the Italian Consumer Code, the buyer will be responsible for the decrease in the value of the products purchased resulting from the use of the products themselves other than that necessary to ascertain their nature, characteristics and functioning.
Payment
For the payment of the price of the products and the related shipping and delivery costs, the buyer can follow one of the methods indicated in the order form (payment on delivery, payment by credit card). In case of payment by credit card, the financial information will be forwarded via encrypted protocol. This information will never be used by Pay01 except to complete the purchase procedures
Shipping and delivery
Each seller on Pay01 independently applies his shipping policy. However, to be more efficient than the large e-commerce groups operating on the Italian territory, Pay01 suggests to the sellers on the Pay01 application to make the delivery in the day and to indicate the timing in the description of the shop.
Log out and delete an account
The Pay01 user will be able to log out of the application by deleting the application from their device. Logging out does not affect the receipt of orders, messages and payments by a store. The store will also be responsible for those orders received while logged out. Account Deletion: Your account can be deleted from My Account/three dots/Delete Account. Once deleted, all account data will be deleted. If there is a POS on the account, the current account data will remain managed by Stripe and can be definitively deleted following Stripe’s procedures.
